3. Registration and Accounts
- Registration with a Google account is required.
- Users agree to provide truthful and accurate information.
- Users are responsible for keeping login credentials confidential.
- Use of the service requires acceptance of these Terms and acknowledgement of the Privacy Policy. If an existing account has no recorded acceptance, the user will be asked to complete it before continuing in the dashboard.
- Consent to commercial communications is optional, is separate from acceptance of these Terms, and can be changed from Account settings.
4. Acceptable Use
- Users must upload only content they own or are authorized to use.
- Only authorized or owned domains may be linked.
- Illegal activity, spam, fraud, and infringement are prohibited.
- Public preview images must comply with applicable law and must not include unlawful or abusive content.
Uploaded images may be processed through optimization workflows to improve compatibility and storage efficiency.
4.1 Prohibited Content (Zero Tolerance)
- Child sexual abuse material or any sexualization of minors
- Violence, abuse, trafficking, hate, or criminal promotion
- Scams, phishing, deceptive practices, or malicious spam
Detection of such activity can result in immediate suspension, content removal, and contact with relevant authorities.
4.2 Responsibility for User-Generated Content
Users are solely responsible for the content they upload, link, or collect. visua.link acts as a technical intermediary and does not perform prior moderation of all user-generated content.
4.3 Subdomains and Slugs
Slugs must consist only of lowercase letters (a-z), numbers (0-9), and hyphens (-), and must be between 2 and 24 characters in length.
Subdomains and slugs are granted as rights of use, not ownership. visua.link reserves the right to unilaterally modify or reclaim any slug that is misleading, offensive, infringing, or used for deceptive purposes.
This includes, but is not limited to, the use of registered trademarks, protected intellectual property, or the impersonation of individuals or organizations (e.g., "microsoft", "google", "apple"). visua.link has the right and the responsibility to reassign such slugs to their rightful owners or to a neutral value to maintain service integrity and legal compliance.
Acknowledgement: By accepting these terms, you acknowledge that any unilateral modification of a project slug by visua.link will cause all previously distributed links associated with that slug to stop working. visua.link is not responsible for any loss of traffic or business resulting from such changes.
5. Third-Party Integrations
The service can connect with Google services, custom webhooks, and generative AI providers such as Google Gemini and OpenAI. Transactional and notification emails are delivered through Amazon Simple Email Service (Amazon SES).
- We request the minimum scopes required to make the activated features work.
- Google Sheets export uses the drive.file permission model.
- Google Calendar integration (for Booking Calendars) uses calendar.calendarlist.readonly to identify the host's primary calendar as the current destination for booking events, and calendar.events to create booking events, invite attendees, retrieve a newly created event when necessary to obtain its Google Meet link, and delete that booking event when it is cancelled. Google grants calendar.events access to view and edit events across the connected account's calendars; visua.link stores each booking event ID and does not display, analyze, modify, or delete unrelated events.
- Webhook and AI use is the customer’s responsibility under the third party’s own terms.
- User-provided AI keys are stored encrypted server-side.
- Email delivery via Amazon SES is subject to AWS's own terms and acceptable use policies.
5.1 Stripe Connect (Paid Bookings)
When a customer (the "host") enables paid bookings on a Booking Calendar, they must connect a Stripe account via Stripe Connect. Payments made by a booking guest are processed directly into the host's connected Stripe account.
- Merchant of record: the host is the merchant of record for those payments. visua.link is a technical facilitator and is not a party to the underlying transaction between the host and the guest.
- Tax obligations: the host is solely responsible for the declaration and remittance of VAT, sales tax, or any other tax applicable to the bookings they sell, in their own jurisdiction and in the jurisdictions of their guests where required.
- Invoicing to the guest: the host is responsible for issuing any invoice or receipt the guest may legally require beyond the payment receipt automatically delivered by Stripe.
- Stripe terms: use of Stripe Connect is subject to Stripe's own terms of service, including its Connected Account Agreement, which the host accepts when onboarding.
- visua.link service fees: visua.link may apply platform fees on amounts processed through Stripe Connect, as disclosed in the pricing page in force at the time of the transaction.
5.2 Stripe Connect — Digital Products and Tips
Digital Products and Tips use the same Stripe Connect arrangement. The Visualink customer who publishes the page is the merchant of record and contracts directly with the buyer or supporter; visua.link supplies only the technical publishing, checkout, delivery, and notification infrastructure.
- Provider obligations: the provider is solely responsible for the product description, availability, fulfilment, intellectual-property rights, tax treatment, consumer information, and every promise made on the public page.
- Provider documents: where applicable, the provider must publish and honour their own terms and conditions, privacy notice, refund/withdrawal policy, and contact details. Visualink does not provide or adopt these documents for the provider.
- Complaints and refunds: complaints about a digital product, access, quality, suitability, refunds, chargebacks, or a donation must be addressed to the provider. visua.link does not arbitrate the underlying transaction and does not guarantee the provider's goods, services, or representations.
- Platform responsibility: visua.link's responsibility is limited to operating the platform as described in these Terms. We do not sell, license, endorse, or warrant customer products.
- Fees: visua.link takes no commission on payments processed through these products. Stripe processing fees and any tax obligations remain the provider's responsibility.
5.3 Booking Calendar — Relationship Between Host, Guest, and Visualink
A Booking Calendar creates a three-party relationship: visua.link as the platform operator, the host (visua.link customer) who publishes a calendar, and the guest who books a session.
- Platform role: visua.link is not a party to the underlying service relationship between the host and the guest. We provide the scheduling, notification, and (optionally) payment infrastructure.
- Host's own terms: the host is responsible for providing the guest with the host's own terms and conditions, privacy notice, cancellation policy, and any other information legally required for the service the host is selling. visua.link does not provide those documents on behalf of the host.
- Cancellation policy: each host selects a cancellation policy from the presets visua.link offers (Flexible, Moderate, Strict) or another policy as the editor allows. The policy determines the refundable portion of the guest's payment, where applicable. visua.link enforces the selected policy automatically; we do not arbitrate disputes about whether a refund should be made outside the policy.
- No-shows, rescheduling, complaints: these are handled directly between the host and the guest. visua.link does not mediate disputes about the underlying service.
- Guest data: the host acts as Data Controller for personal data of guests submitted through the booking form. visua.link acts as Processor under the DPA in section 11 of the Privacy Policy.
- Cancellation fees / Stripe fees: Stripe does not return its processing fee when a refund is issued. The host accepts that the Stripe fee on the original charge is not recoverable and is absorbed by the host (not visua.link) when a refund is processed.
5.4 Visualink for Artists and Social Organizations
visua.link may grant Partner status, at its sole discretion, to emerging artists and social organizations, or to other profiles visua.link considers a meaningful fit for the program, through the Visualink for Artists and Social Organizations program. Formal documentation is not required to apply.
- Eligibility: Partner status is assessed flexibly and individually. Applying for the program does not create an entitlement to approval or continued participation.
- Partner access: while Partner status remains active, the account receives the same product access and feature availability as the Scale plan, including additions and improvements made available to that plan.
- Profile showcase: by accepting or retaining Partner status, you grant visua.link a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and link to your public profile, projects, and associated public content (including your profile name, image, branding, bio, and public links) as an example or case study across the visua.link website and product. visua.link may decide where and how to feature this content at its discretion. This permission applies only to content you have made public through the service and does not transfer ownership of that content.
- Program conditions: Partner accounts remain subject to these Terms, including the acceptable-use rules. visua.link may refuse, suspend, or withdraw Partner status at its discretion, including where the account breaches these Terms or the program is no longer appropriate for the account.
6. Suspension and Termination
- visua.link may suspend or terminate accounts that breach these terms.
- We may also refuse or terminate service where legal, contractual, or competitive conflicts arise.
- Suspension does not remove pending payment obligations.
- After cancellation or account closure, visua.link may delete user-created images, links, forms, and related records. This implies that all distributed links will stop working and any associated project slugs will become available for use by other users.
7. Payments and Refunds
This section covers payments to visua.link for the platform subscription. Payments made through Booking Calendars, Digital Products, or Tips via Stripe Connect are governed by sections 5.1–5.3 and by the provider's own terms and refund policy.
- Payment method: credit or debit card via Stripe.
- Refund policy: for the visua.link subscription, we offer a 15-day satisfaction guarantee and a full refund for unauthorized or erroneous charges. This guarantee does not apply to amounts paid to a customer through Stripe Connect.
- Applicable taxes on the visua.link subscription are the responsibility of the customer. Taxes on amounts collected by hosts via Stripe Connect are the responsibility of the host (see section 5.1).
8. Limitation of Liability
- The service is provided as is, without guarantees of uninterrupted availability.
- Maximum liability is limited to the total amount paid by the user, excluding direct taxes.
- visua.link is not responsible for indirect damages, data loss, or lost profits.
- We are not responsible for failures inside third-party services such as Google Sheets or other integrations.
9. Governing Law and Dispute Resolution
- These terms are governed by the laws of Portugal.
- Disputes should first attempt online arbitration.
- Courts of Portugal have exclusive authority if arbitration does not resolve the dispute.
10. Modifications
- visua.link may update these terms at any time.
- Updates are posted on this page with the updated date.
- Users should review the terms periodically.
